Purpose of ESP Application
The Emergency System Partnership (ESP) Application is designed to support situational awareness, coordination, and information sharing among authorized partners, emergency service agencies, and, when appropriate, the public.
ESP Application is intended to supplement existing emergency response communication systems. ESP Application does not provide emergency services, does not replace 911 or dispatch systems, and does not independently initiate emergency actions.
Authorized Use
Access to ESP Application is limited to authorized governmental entities, approved emergency service partners, and users granted access by an authorized organization.
Users agree to use ESP Application only for lawful purposes, within the scope of granted permissions, and in accordance with applicable laws and policies.
License and Ownership
ESP Application is licensed, not sold. Natural Resources Solutions, L.C. (NRS) retains all rights, title, and interest in the ESP Application and all related intellectual property.
Terms and Access Duration
Use of ESP Application is permitted only during the term of an active licensing agreement. Upon expiration or termination, access may be suspended or terminated.
System Updates and Availability
NRS may update or modify ESP Application to improve performance, security, or functionality. Continuous availability is not guaranteed.
Data and Information Use
ESP Application displays information for informational sharing, coordination, and situational awareness purposes only. Information may be subject to change or limitations and should not replace professional judgment or official directives.
Confidentiality
Certain information accessible through ESP Application may be confidential. Users must protect such information and use it only for authorized purposes.
Third-Party Services
ESP Application integrates information from third-party platforms and services, such as Esri services. Use of such services is subject to their respective terms and availability.
No Warranties
ESP Application is provided 'as is' and 'as available' without warranties of any kind.
Limitation of Liability
NRS shall not be liable for indirect or consequential damages. Total liability shall not exceed applicable licensing fees.
Indemnification
Users agree to indemnify and hold harmless NRS from claims arising from misuse or unauthorized use of ESP Application.
Suspension or Termination
NRS may suspend or terminate access for violations, security risks, or expiration of licensing agreements.
Governing Law
These Terms are governed by the laws of the State of Texas, with venue in Coryell County, Texas.
Changes to These Terms
NRS may update these Terms periodically. Use of ESP Application constitutes acceptance of Terms/Revised Terms.
